These Terms & Conditions (Terms) govern your use of the COMCA platform, website, marketplace, and services. By accessing or using COMCA, you agree to be bound by these Terms.

1. Definitions

“COMCA”, “we”, “us”, “our” means COMCA Pty Ltd.

“Services” means intake, cataloguing, storage, imaging, listing, marketplace access, consignment, sales fulfilment, packing, shipping coordination, returns handling, and related support for trading cards and collectibles.

“Client”, “you” means any person or entity using the Services.

“Declared Value” means the per-item value you state in your manifest at intake, used solely for liability caps and optional insurance calculations.

“Carrier” means Australia Post or any courier selected by you or by us on your behalf.

“Policies” means the documents incorporated by reference into these Terms.

“Marketplace” means the COMCA online platform enabling users to buy, sell, submit, store, and manage items.

“User Content” means any photos, descriptions, data, listings, messages, or other material submitted by you.

2. Scope of Services & Exclusions

2.1 We provide the Services using reasonable care and skill.

2.2 We do not provide authentication, grading, appraisal, investment advice, or guaranteed condition outcomes unless expressly stated in writing.

2.3 We are not an insurer. Insurance is available only where expressly requested, accepted by us, confirmed in writing, and paid in full.

2.4 Grading and condition assessments are inherently subjective and outside our control.

3. Account Registration, Identity Verification & Client Warranties

3.1 You warrant that you are at least 18 years old and the lawful owner (or authorised agent) of all items tendered.

3.2 You must maintain accurate account details and secure your login credentials.

3.3 We may require identity verification (KYC) under Stripe Connect or applicable law. Failure to complete verification may result in withheld payouts or account suspension.

3.4 You must not create multiple accounts to evade fees, restrictions, or enforcement actions.

4. Marketplace Use

4.1 COMCA provides a platform for users to buy and sell items. Unless expressly stated, COMCA is not a party to transactions between users.

4.2 Buyers and sellers are responsible for ensuring listing accuracy, lawful conduct, and compliance with these Terms.

4.3 You must not engage in:

  • false, misleading, or deceptive listings
  • fee avoidance
  • off-platform transactions
  • shill bidding or artificial price manipulation
  • harassment, abuse, or unsafe conduct
  • attempts to circumvent COMCA’s systems

4.4 We may remove listings, restrict accounts, or cancel transactions where we reasonably suspect fraud, error, or policy violations.

5. Listing Accuracy & User Content

5.1 You are responsible for the accuracy of all listings, titles, conditions, set codes, and descriptions.

5.2 By submitting User Content, you grant COMCA a worldwide, royalty-free licence to host, display, reproduce, and use such content for operating the platform.

5.3 You warrant that User Content does not infringe any third-party rights.

5.4 We may edit, correct, or standardise listing data for accuracy and consistency.

6. Intake, Manifests & Evidence

6.1 You must submit a complete manifest listing quantity, title, set, serial or identifying information (if applicable), and Declared Value.

6.2 Items not listed on the manifest are not accepted into inventory and cannot be claimed as missing, except where required under the ACL.

6.3 Claims for loss or discrepancy must include, where reasonably available:

  • shipping receipt or carrier confirmation
  • uninterrupted video of packing or unsealing
  • clear photos of contents
  • a copy of the submitted manifest

6.4 Our intake counts, scans, and images constitute prima facie evidence unless you demonstrate a clear error within three (3) business days.

7. Processing Times

7.1 All processing times are estimates only.

7.2 Delays do not constitute breach provided services are supplied within a reasonable time under the ACL.

7.3 Expedited handling is best-effort unless a paid SLA is agreed in writing.

8. Shipping & Risk of Loss

8.1 Risk transfers to us when items are logged into our inventory system.

8.2 Risk transfers back to you when items are delivered to the Carrier and a carrier scan is obtained.

8.3 Where you elect uninsured shipping, you accept all transit risk.

9. Liability, Bailment & Caps

9.1 To the maximum extent permitted by law, our total liability for any individual item is limited to the lesser of:

  • its Declared Value; or
  • AUD $100 per item, unless optional insurance has been purchased.

9.2 We are not liable for:

  • market fluctuations
  • lost profits
  • sentimental value
  • grading outcomes
  • missed sales opportunities
  • indirect or consequential loss

9.3 Nothing in these Terms excludes non-excludable ACL rights.

10. Fees, Payouts, Holds & Chargebacks

10.1 Fees are published on our platform and may change with notice.

10.2 You authorise us to deduct fees from sale proceeds or charge your nominated payment method.

10.3 Payouts are processed via Stripe Connect and may be subject to:

  • KYC verification
  • fraud checks
  • reserve holds
  • compliance reviews

10.4 If you initiate a chargeback:

  • we may freeze your account and items
  • payouts may be suspended
  • if unresolved after sixty (60) days, we may liquidate items to recover outstanding amounts
  • liquidation will be limited to the amount required

10A. COMCA Credits & Wallet

10A.1 COMCA Credits are prepaid digital tokens used solely to pay for COMCA services and marketplace purchases. Credits are not money, not stored value, and not a financial product.

10A.2 Credits cannot be redeemed for cash, withdrawn, transferred between users, or converted back into Seller Earnings once converted.

10A.3 Only Seller Earnings (real AUD from sales) are withdrawable, processed via Stripe Connect.

10A.4 Full terms governing Credits, the Wallet, and Seller Earnings are set out in the COMCA Credits, Wallet & Payouts Policy, which is incorporated into these Terms by reference.

11. Website Use & Acceptable Use

11.1 You must not:

  • scrape, harvest, or extract data
  • reverse engineer or interfere with the platform
  • upload malware or harmful code
  • use automated bots without permission
  • attempt to bypass security controls

11.2 We may suspend or restrict access for security, maintenance, or policy enforcement.

12. Refusal of Service & Termination

12.1 We may refuse service or suspend/terminate accounts for abusive behaviour, repeated violations, unreasonable risk, or suspected fraud.

12.2 We will act reasonably and lawfully when exercising these rights.

13. Dispute Resolution & Governing Law

13.1 Disputes must first be raised with support, allowing fourteen (14) days for response.

13.2 Unresolved disputes may be referred to mediation in New South Wales.

13.3 The courts of New South Wales have non-exclusive jurisdiction.

14. Australian Consumer Law

14.1 Nothing in these Terms excludes rights under the ACL.

14.2 Where permitted, our liability is limited to resupplying the Services or paying the cost of doing so.

15. Privacy

We handle personal information in accordance with our Security & Data Handling Policy and the Australian Privacy Principles.

16. Changes to Terms

16.1 We may update these Terms by posting a new version on our website.

16.2 Continued use after the effective date constitutes acceptance.

16.3 Material adverse changes do not apply retroactively to items already accepted.

17. Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control.
